OblyssPro Platform Terms of Service

These Platform Terms of Service (the “Terms”) govern access to and use of the websites, applications, software, and related services that Oblyss Incorporated makes available under the Oblyss and OblyssPro brands (collectively, the “Services”). “Oblyss,” “we,” “us,” and “our” mean Oblyss Incorporated, a Delaware corporation.

By clicking an acceptance button or checkbox, creating or using an account after being presented with these Terms, starting a trial, purchasing a subscription, or signing or accepting an Order, you agree to the Agreement. If you do not agree, do not access or use the Services.

1. Who Is Agreeing and What Documents Apply

1.1 Customers, Administrators, and Authorized Users

A “Customer” is the business or other organization that creates, purchases, or is named in an account or Order. An “Authorized User” is an individual whom a Customer permits to use the Services. A “Customer Administrator” is an Authorized User with administrative authority over account functions such as users, configuration, integrations, or non-owner settings.

An “Account Owner” is the Authorized User designated as the primary account owner (typically the individual who created the account). Only the Account Owner may: (a) manage the Customer’s paid subscription and cancellation; (b) request deletion of the Customer organization; (c) request a full export of supported Customer Data; or (d) transfer account ownership to another Authorized User.

If you accept these Terms for a Customer, you represent that you are at least 18 years old and have authority to bind that Customer. The Customer is responsible for its Authorized Users and their use of the Services.

1.2 Orders and Agreement Priority

An “Order” means an online checkout or subscription selection, order form, or other ordering document. These Terms, each applicable Order, and any signed Data Processing Addendum form the “Agreement.”

At subscription checkout, Oblyss will present the then-current Terms and Privacy Policy and require affirmative acceptance before payment. Oblyss will record the accepting user, Customer name, acceptance date and time, IP address, and the version identifiers of the Terms and Privacy Policy accepted.

2. Eligibility and Account Registration

The Services are intended solely for business use in the United States. Each individual user must be at least 18 years old. Customers and Authorized Users must provide accurate registration information, keep it current, and use only accounts assigned to them. Credentials may not be shared among individuals.

3. Access to the Services

3.1 Limited Right to Use

Subject to the Agreement and payment of applicable fees, Oblyss grants the Customer a limited, non-exclusive, non-transferable right during the subscription term to permit its Authorized Users to access and use the Services for the Customer’s internal business operations.

3.2 Customer Administrators and Purchases

Customer Administrators may invite or remove users, assign roles, configure workflows, and enable features. Only the Account Owner may purchase, modify, renew, or cancel paid subscriptions, delete the organization, transfer ownership, or request a full data export.

3.3 Trials, Demos, and Early-Access Features

Unless the checkout page states otherwise, a self-service trial lasts 14 days and does not require a payment method. A trial does not automatically convert to a paid subscription and will not result in any charge. Trial, preview, beta, sandbox, or demo features may change or be discontinued and are provided without service commitments.

4. Subscriptions, Renewals, Fees, and Taxes

4.1 Subscription Term and Automatic Renewal

Oblyss offers the following billing options:

  • Month-to-month: billed each month and automatically renewed until the Account Owner cancels.
  • Annual: billed once in advance at a 10% discount off the equivalent monthly price, renewed for successive twelve-month terms at the then-current rate until cancelled.

For annual subscriptions, Oblyss will send Account Owner email reminders approximately 35 days and 10 days before the annual renewal charge.

4.2 Cancellation

The Account Owner may cancel a paid subscription through the billing portal. Cancellation stops the next renewal and takes effect at the end of the current paid period. Prepaid annual fees are not refunded upon cancellation except as required by law.

4.3 Fees, Payment Authorization, and Taxes

Oblyss does not receive or store full payment card numbers, CVV codes, or bank account numbers. Payment credentials are submitted to the applicable processor. Fees exclude applicable taxes; the Customer is responsible for those taxes except taxes based on Oblyss’s net income.

4.4 Failed Payments, Disputes, and Suspension

If a payment fails, Oblyss may retry the payment method, request another method, restrict paid features, or suspend access after reasonable notice. A chargeback does not cancel a subscription.

4.5 Refunds, Credits, and Price Changes

Fees for a paid term are earned when the term begins and are non-refundable except as required by law. Oblyss may change fees prospectively with notice; the Customer may cancel before the new price takes effect.

4.6 Professional Services

Onboarding, data migration, training, and configuration are optional professional services quoted separately from the subscription. Delivery depends on the Customer’s timely cooperation.

4.7 Customer-Authorized Data Migration

At the Customer’s request, Oblyss may access Customer-designated third-party accounts solely to perform agreed data-migration services. Before Oblyss begins a migration, the Account Owner must record a migration authorization in the Services. The Customer must maintain an independent backup of its source data.

5. Customer Data and Account Content

5.4 Privacy, Security, and Subprocessors

Oblyss may use subprocessors listed in Appendix A to provide, secure, and support the Services. Oblyss will provide reasonable notice of material subprocessor changes. For visitors to Oblyss marketing websites, Oblyss provides cookie and privacy choice controls and honors applicable Global Privacy Control signals.

6. AI-Assisted Features

6.4 Role-Based AI Controls

The Customer may configure whether service technicians and similar field roles may use AI contract and estimate drafting features. Where enabled, the Customer may require human review and approval before AI-generated language is sent to a customer or used in a signing workflow. Oblyss configures AI providers so Customer Data is not used to train general-purpose models, to the extent provider terms permit.

7. Estimates, Documents, Signatures, and Professional Workflows

Native electronic signature: The Services include a native electronic-signature workflow that captures signer name, email, signature image, timestamps, and related metadata. Unless the Customer uses DocuSign or another Connected Service, the native workflow does not provide certificate-of-completion, PKI, or tamper-seal controls equivalent to a certified e-signature platform.

8. Customer Communications, Recording, and Location

8.2 Call Recording and Transcription

Call recording and transcription are off by default. If the Customer enables either feature, the Customer must provide all legally required notices and obtain legally sufficient consent before recording or transcription begins. Recordings and transcripts are accessible only to Authorized Users in roles configured by the Customer.

8.3 Location and Field Workforce Features

Location collection for field workforce features is designed to operate during enabled work periods (for example, while clocked in) and to stop when that period ends. The Services may display an indicator when location sharing is active.

8.4 Authorized User Notification Preferences

Each Authorized User may configure personal notification preferences in the Services, including email and SMS alerts for categories such as new appointments, contract signing events, team alerts, overdue invoices, and deposit notifications.

9. Payments and Financial Workflows

9.1 End-Customer Payments (Stripe Connect)

For a Customer’s collection of payments from its end customers, the Services use Stripe Connect with Express connected accounts. The Customer is the merchant of record. Unless a different fee is shown, Oblyss charges a 0.5% platform application fee on end-customer payment volume processed through the Services.

9.2 Subscription Payments to Oblyss

Payments to Oblyss for subscriptions are processed through Stripe checkout and billing.

9.3 QuickBooks Online (Accounting Sync)

The Services may connect with Intuit QuickBooks Online to sync customers, invoices, expenses, payments, and related accounting records. Oblyss does not process end-customer card or ACH payments through QuickBooks Payments.

10. Connected Services and Third-Party Information

Customer-configured automation platforms connected through the Lead Ingestion API or outbound webhooks are Customer-directed integrations. Those platforms are not Oblyss subprocessors unless expressly identified in Appendix A.

11. Intellectual Property

The Services and their original content, features, and functionality are the exclusive property of Oblyss Incorporated and its licensors. Your data remains your property. Oblyss claims no ownership of your business data.

12. Data Export, Retention, and Deletion

12.1 Export and Retention

During an active subscription or trial, the Customer may use available export tools to retrieve supported Customer Data. For the first 30 days after a paid subscription or trial ends, the Account Owner may request an export.

12.2 Reactivation After Cancellation

For 60 days after cancellation (the “Reactivation Period”), Oblyss will retain Customer Data in a suspended state. If the Customer reactivates during that period, Oblyss will use commercially reasonable efforts to restore access.

13–24. General Terms

Sections 13 through 24 cover: prohibited conduct, disclaimers, limitation of liability, indemnification, termination, governing law (State of Tennessee), dispute resolution, class action waiver, force majeure, notices, assignment, and severability.
